Please read these Terms and Conditions ("Terms") carefully before using the CardBuilder web application and services ("Service") operated by SOUIDI LLC ("Company," "us," "we," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("You"), and SOUIDI LLC concerning your access to and use of the CardBuilder service.
You affirm that you are 18 years of age or older and are fully competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.
CardBuilder is a platform that allows users to create, manage, and share digital business cards (vCards) online.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unautho1rized use of your account.
If you use the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms. You are responsible for ensuring all team members comply with these Terms.
You retain all ownership rights in and to the content you create, upload, or display on the Service, including photos, logos, text, links, and contact details (collectively, "User Content").
You acknowledge that the primary function of the CardBuilder service is to publicly display your User Content (your digital card). By uploading User Content, you grant SOUIDI LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and display the User Content solely for the purpose of operating and providing the Service.
You agree not to post User Content that:
Is unlawful, harmful, threatening, abusive, or harassing.
Contains any sexually explicit or graphic content.
Infringes upon the rights of any third party, including copyright, trademark, privacy, or intellectual property rights.
Contains viruses or any other harmful code designed to interrupt, destroy, or limit the functionality of the Service.
SOUIDI LLC reserves the right to remove any User Content at any time, for any reason, without notice.
Grant of Trial: CardBuilder may offer a 30-day free trial ("Trial Period") which grants you temporary access to the full features of a paid subscription plan, without charge.
Duration: The Trial Period is strictly 30 calendar days, beginning on the date you activate the trial.
Conversion: At the conclusion of the Trial Period, your access to the full feature set will automatically cease. You will not be charged unless you actively choose to purchase a paid subscription.
Trial Data: Any User Content (digital cards, contact data, etc.) created during the Trial Period will be preserved for a reasonable period (typically 30 days) to allow for conversion to a paid plan. If you do not convert, your content may be downgraded to a limited free tier or permanently deleted, as communicated to you via email.
Modification/Termination of Trial: SOUIDI LLC reserves the right to modify the terms of the free trial or withdraw the free trial offer at any time, with or without notice.
The Service is offered on a free tier and various paid subscription tiers. Details of the fees and features for each tier are published on the CardBuilder website.
When you purchase a subscription, you agree to pay the fees and charges at the time they are due. Payments are typically billed in advance on a recurring, periodic basis (e.g., monthly or annually).
Your paid subscription will automatically renew at the end of each billing cycle unless you cancel the subscription through your account management page or by contacting support before the renewal date.
SOUIDI LLC reserves the right to adjust pricing for the Service or any components thereof in any manner and at any time as it may determine in its sole and absolute discretion. Any price changes will take effect following notice to you.
All subscriptions are non-refundable, except where required by law.
You may cancel your subscription and terminate your account at any time through your CardBuilder account settings.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
The Service and its original content, features, and functionality are and will remain the exclusive property of SOUIDI LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written conse2nt of SOUIDI LLC.
In no event shall SOUIDI LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
These Terms shall be governed and construed in accordance with the laws of The State of Wyoming, USA], without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
